REGISTERING A BUSINESS NAME IN DTI BAGUIO CITY

Have you decided to start a business?
Have you already given it a name or a unique trademark?
Are you sure that business name is taken or not from barangay to regional or to national?

If you want to have the sole right to use the business name, register it with DTI (Department of Trade and Industry).

You may register your business name by visiting the DTI regional or provincial office or Negosyo Center nearest you. You can also apply online through the Business Name Registration System (BNRS).

If you decide to apply through walk-in, you may download the business name registration forms for you to print two copies and accomplish them prior to your visit.

These are the instructions in accomplishing the forms:





*I went to DTI BAGUIO City Hall at One – Stop Shop and inquire about how to register my business name for my sari-sari store. They gave me the application form and fill it up. They ask me if, what is my proposed business name in order to check it out if it’s not yet taken and what business scope do I want?

These are the business name scope :

1.     Barangay (worth 200 pesos)
-         You can use this if you want to stick in your barangay area only.
-         You can branch out within your barangay using your registered business name.
2.     City or Municipality (500.00)
-         You can use the business name and branch out within your Municipality or City only.
3.     Regional (1000.00)
-         You can use the business name and branch out throughout your region only.
4.     National (2000.00)
-         You can use the business name and branch out your business anywhere in the Philippines.

You need to think twice about what type of business name scope will you choose. For me, my business is within the barangay area of Baguio City but dreaming to branch out or transfer my business to a more populated area where traffic is denser. So, I decided to choose the Municipal/City and paid 500 pesos plus 30 pesos for the stamp.  The advantage is it’s cheaper and it serves its purpose while the disadvantage is  I can have the sole right of the business name within Baguio City only. Meaning I can have same business name in other areas in the Philippines. If you want a business and hope to venture around the Philippines sooner then choose National.

I received my Certificate of Business Name Registration after a day upon registration. The validation of the BN certificate is 5 years and it ’s renewable. 

Purpose of Business Name Registration:
a)     The primary purpose is to provide protection to the public dealing with a
business establishment through disclosure of the identity and citizenship of the person owning the business as well as other facts of records in the Department of Trade and Industry.
b)     To prevent a business establishment from using a name that is identical or confusingly similar to the name of another registered business establishment.

QUALIFICATIONS:
 A person who is at least twenty-one (21) years old, doing business or proposing to do business in the Philippines under a Business Name and who is not disqualified by any existing law or regulation to engage in business isrequired to register under the BN Law.

REQUIREMENTS:
The applicant must be a natural born Filipino citizen and shall comply with the following requirements:
a)  Duly accomplished application form in the prescribed format;
b)  Payment of the prescribed fee and documentary stamp tax;
c)  Original and clear photocopy of any of the following:
1.  Voter's Identification Document (ID);
2.  Postal ID;
3. Passport;
4. Driver's License;
5. Professional Regulations Commission (PRC) ID;
6. Government Service and Insurance System (GSIS) e-Card;
7.Social Security System (SSS) Card;
8. Senior Citizen ID;
9. Persons with Disability ID;
10. Government Office ana Government Owned and Controlled Corporation- issued ID'
11.Integrated Bar of the Philippines ID; and
12. Suefi other IDs that the Director may deem fit to establish the identity

HOW TO GET BMBE CERTIFICATE IN BAGUIO CITY?

Have you ever wonder what is BMBE all about?
How does it help you and what are the benefits of acquiring one?
What are the requirements? and etc...  

I got my BMBE Certificate last July 2018 at DTI one-stop shop in  Baguio City Hall.
I will share with you guys, on how I got one, but before that let's know first if what is BMBE?

 BMBE is known as Barangay Micro Business Enterprise. It is defined under the BMBE law, RA.9178 Act of 2002 as "any business enterprise engaged in production, processing, or manufacturing of products, including agro-processing, as well as trading and services, with total assets of not more than Php 3,000,000. Such assets shall include those arising from loans but not the land on which the plant and equipment are located."

The DTI issued Department Administrative Order (DAO) No. 16-01 last April 22, 2016 which provides guidelines on registering BMBEs at Negosyo Centers. Under DAO 16-01, DTI is the sole agency which shall issue a Certificate of Authority (CA) to registered BMBEs at Negosyo Centers or at DTI offices where Negosyo Centers have not been set up.


ELIGIBILITY OF BMBE APPLICATION

Any person, natural, or juridical, such as partnership, corporation, association, and cooperative, having the qualifications and none of the disqualifications shall be eligible to register as BMBEs.

QUALIFICATIONS OF BMBE 

A person applying to be  registered as a BMBE shall meet the following qualifications:

a) With an asset of not more than 3 Million Pesos (PhP3,000,000.00) excluding land;

b) Engaged in the production, processing or manufacturing of products or commodities, including agro-processing, trading, and services:

c) Registered with the Department of Trade and Industry (DTl) for sole proprietorships; for juridical persons: with the Securities and Exchange Commission (SEC), for corporations and associations; and
with the Cooperative Development Authority for cooperatives. 

However, entities rendering services in connection with the exercise of one's profession by a person duly licensed by the government after having passed a government licensure examination are disqualified from applying for BMBE Certificate of Authority.

REQUIREMENTS FOR REGISTRATION:

a) Certificate of Business Name Registration from the Department of Trade
and Industry (DTl), or

b) Certificate of Registration from the Securities and Exchange Commission
(SEC), or

c) Certificate of Registration from the Cooperative Development Authority
(CDA).

STEP BY STEP PROCEDURE:

1. Accomplish and file the application form for BMBE Certificate of Authority;

2. The DTI, through the Negosyo Center, evaluates the application for purposes of determining the eligibility and qualification as a BMBE;

3. The DTI, after finding the applicant to be eligible and qualified, issues the BMBE Certificate of Authority  within fifteen (15) working days from receipt of application with complete requirements; otherwise, the BMBE Certificate of Authority shall be deemed approved (wherein such
a case, it becomes ministerial on the part of DTI to issue the BMBE
Certificate of Authority). The BMBE Certificate of Authority shall be effective for a period of two (2) years commencing from the date of issuance. The CA may be renewed for the same period of two (2) years and every two (2) years thereafter subject to the applicant's continued compliance with the eligibility requirements as prescribed by law and this DAO.


I thought it's hard to apply, but from the requirements itself, it's easy as long as you are eligible.  You just need to go and fill up the application form from DTI Negosyo Centers or you can download the form from DTI's website.

Fill up three copies of the application form, then submit to DTI booth in Baguio City Hall One- Stop Shop. If you are renewing or applying for your business permit it's recommended to go to One - Stop Shop for less hassle.

If your business is new, you need to register first your Trade Name to DTI. I fill up an application form for business name registration consisting of two copies.

We need to have the Certificate of Business name  Registration first before you can apply for BMBE.   For my case, I applied for both at the same time. I got first my CBNR after a day and got my BMBE Certificate after 2 days. 

*note: applying for BMBE is totally free 

My business is a Sari-sari Store and it is under Trading (wholesale/retailer) which is eligible for BMBE.  I declared less 50k as my starting capital (As wise men say, " declare a lesser amount than your actual capital..." Then, what's the use of having BMBE Certificate?

BENEFITS AND INCENTIVES OF BMBEs

  • Exemption from taxes and fees.                                                                                                    -All BMBEs shall be exempted from income tax for income arising from the operation of the enterprise.                                                                                                                                        -The Local Government Units (LGUs) are encouraged either to reduce the amount of local taxes, fees and charges imposed or to exempt the BMBE from local taxes, fees, and charges.
  •  Exemption from the Coverage of the Minimum Wage Law
- The BMBEs shall be exempt from the coverage of the Minimum Wage Law: Provided, That all employees covered under the Act shall be entitled to the same benefits given to any regular employee such as social security and healthcare benefits.

  • Credit Delivery                                                                                                                           
    - the Land bank of the Philippines (LBP), the Development Bank of the Philippines
    (DBP), Small Business Guarantee and Finance Corporation (SBGFC),
    and People’s Credit and Finance Corporation (PCFC) shall set up a
    special credit window that will service the financing needs of BMBEs

    registered under the Act consistent with the BSP policies, rules and
    regulations. The Government Service Insurance System (GSIS) and
    Social Security System (SSS) shall likewise set up a special credit window
    that will serve the financing needs of their respective members who wish
    to establish a BMBE.
  • Technology transfer, production, and management training and marketing assistance programs for BMBE Beneficiaries.

* In order to know, if you are qualified, visit DTI Baguio for further assessment. Onlineshop, dry goods, clothing, sari-sari store, buy and sell and etc... are qualified as what I know. I will update soon if BIR will accept my BMBE Certificate and exempt me from paying income tax.

In falling in love, does age matters?

We cannot choose our own parents and it seems that we cannot choose whom we can fall in love with either.

Most people don’t have exact answers when asked if why they love someone. “I love him/her because I love him/her.” “I love him/her not because of his /her physical appearance but because he/ she is whom my heart beats for.”

We have unexplainable and different answers but that’s when we know that we are loving someone truthfully. Love knows no boundaries so it has no factors set when choosing someone whom we can love.

But some people seem not to agree. When it comes to falling in love, some factors matter, like age. There are two sides of a coin here:

In falling in love, age does matter.
 In falling in love, age doesn’t matter.

Despite our modern society, people still think the traditional way, that age is a factor to consider when loving someone. Couples having wide age gaps are being criticized and talked about by the community. A man falling in love with a woman much older than him and the other way around, having 20 years or more age gap is unusual to people. Some would say, “She could even be your mother/ he could even be your father.  Find someone of your age.” But who are they to judge and dictate whom you can love? They are not you, after all.

We certainly know of couples who have wide age gaps but are happy with each other despite other people opposing their love. In showbiz, to name a few, we have couples Robin Padilla and Mariel Rodriguez, Hayden Kho and Vicky Belo, and Vic Sotto and Pauline Luna.

There are some reasons why a wide age gap is not an obstacle in love:

Fatherly/ Motherly Figure
There are people who seek fatherly/ motherly affection and they find it from their partners. Loving and caring partners are easy to be loved and you will feel the assurance of being secured.

Same preferences and Interests
Two people, despite their age gap, can be bind by their same preferences and interests. Since they have many things in common, their tendency of building a harmonious relationship is high.

Love
Love is the strongest feeling that ties a couple together. It is the wonderful thing that is alive in a great relationship.


With these reasons, age is disregarded and is a less matter to consider when falling in love. We all have the right to fall in love and be loved. Others cannot judge or dictate whom we can fall in love with so long as we are happy and assured that we are loved in return.
